The Racing Appeals Tribunal has handed down its decision regarding the 29 October 2004 appeal by licenced trainer Mr Martin Herbert.

 

Harness Racing Victoria (HRV) Stewards had previously disqualified Martin Herbert for a period of 12 months and a $5,000 fine on two separate occasions, for breaching HRV Rule 190 (1) & (2), in that he presented Antigua Bay to race at Cranbourne on 7 February, 2004 and Bally Hooley to race at Maryborough on 5 May 2004 with the prohibited substance propantheline in their systems.

 

Mr Herbert lodged an appeal against the severity of the penalty imposed by the Stewards.? The tribunal allowed Mr Herbert?s appeal and varied the penalties to a period of 3 months disqualification on each charge to be served cumulatively, totalling 6 months disqualification.
