APPEAL DECISION – JAMES RATTRAY 

 

The Tasmanian Racing Appeal Board has released its decision in relation to an appeal by Mr Rattray against a six week suspension of his driver’s licence under Rule 149(1)(a) of the Rules of Harness Racing, “failing to take all reasonable and permissible measures to finish in the best possible placing” when driving Never Say Sorry in Race 5 at the meeting conducted by the Devonport Harness Racing Club on Monday, 19 May 2008. 

 

The appeal was heard by the Board on Monday, 26 May 2008, resulting in the following finding:

 

1.             The Appeal was dismissed.  The penalty was varied.  The Board reduced the penalty imposed by the stewards to a four week suspension which will expire at midnight on 23 June 2008.

2.             The Deposit is to be refunded.
