Called to inquiry Miss Kerry Green Trainer of Giftedfromtheheart and Mr. Phillip Westbury Owner of Giftedfromtheheart.

Stewards on Wednesday 8th May 2024 resumed the inquiry which had adjourned on Wednesday 26th April 2024 into the analysts report on swab sample taken from Giftedfromtheheart following its winning performance in Race 5 at Port Pirie on 13th February 2024.

At the inquiry on 26TH April 2024 Trainer Miss Kerry Green had pleaded not guilty to a charge under AHRR 190 (1),(2) and (4) of presenting Giftfromtheheart for the race when not free of the prohibited substance Cobalt.

Miss Green had pleaded guilty to a charge under R194B (1) (2) of having in her possession a product which contained Cobalt Salts namely Hemoplex.

Further evidence was taken from Miss Green and Mr. Westbury along with a written submission from Mr. Westbury including a receipt for when and where he had purchased the product Hemoplex for treating a recreational horse at his property.

Stewards after considering this evidence believed Giftedfromtheheart was not free of the Prohibited Substance at Port Pirie where it competed in and won Race 5 the Get Well Neville & Jenny Thomson Pace and Miss Green was found guilty to the charge.

Following a joint address on penalties from Miss Green and Mr. Westbury and considering previous penalties by HRSA Stewards and Miss Greens record of no prior offences,  the following penalties, and directions in respect to the two charges were imposed.

Charge 1. AHRR 190 (1), (2) and (4) Suspension of her Licence for 12 months with a direction that in this time she may not have any pecuniary interest in any Horse Racing or Trialling.

Charge 2. AHRR 194B (1) and (2) Fine of $250.

An order to pay $500 towards the cost of confirmatory analysis. AHRR 310 (1).

Furthermore, in accordance with AHRR 195 Giftedfromtheheart disqualified as winner of the race with placings amended accordingly and stake money forfeited.

Both persons were advised of their right to Appeal the Stewards decisions.
