New Inquiries –

28 October 2023– Mr Brad Abbott – HRNSW Stewards have commenced an investigation in relation to a report from the Australian Government National Measurement Institute (NMI) that Arsenic above the threshold of 0.30 micrograms per millilitre in urine was detected in the urine sample taken DON BOSTON following its win in race 4, the HOTEL DUDLEY PACE (1730 metres) conducted at Bathurst on Wednesday 5 July 2023.

The reserve portion and control solution have been confirmed by the ChemCentre in Western Australia.

Inquiries Conducted –

9 October 2023– Mr Brad Elder –  HRNSW Stewards conducted an Inquiry in relation to a report from the Australian Racing Forensic Laboratory (ARFL) that Levamisole was detected in the post-race urine samples taken from;

  • LIL RIPPER NZ following its win in race 7, the NATIONALTROTGUIDE.COM.AU PACE (1609 metres) conducted at Newcastle on Friday 4 November 2022;
  • LIL RIPPER NZ following its win in race 2, THE FEATURE SWEEPSTAKES MAIDEN PACE (2030 metres) conducted at Newcastle Monday 7 November 2022;
  • LIL RIPPER NZ following its win in race 2, the BESTINBEDS.COM.AU WARATAH FINAL (1609 metres) conducted at Tabcorp Park Menangle on Saturday 10 December 2022.

The reserve portions and control solutions were confirmed by Racing Analytical Services Limited (RASL) in Victoria.

Trainer Mr Brad Elder was present was present with his legal representative and provided evidence to the Inquiry. In addition, the Certificates of Analysis and evidence from HRNSW Regulatory Veterinarian Dr Martin Wainscott were presented to the Inquiry.

Mr Elder pleaded guilty to three (3) charges issued by HRNSW Stewards pursuant to Australian Harness Racing Rule (AHRR) 190 (1), (2) & (4) and he was disqualified for a period of 10 months to commence immediately.

Acting under the provisions of AHRR 195, LIL RIPPER NZ was disqualified from the abovementioned races.

Mr Elder has appealed the decision of HRNSW Stewards.

20 October 2023– Mr Greg Fleming – HRNSW Stewards conducted an Inquiry in relation to a report from the Australian Racing Forensic Laboratory (ARFL) that Peptides VYSNFLR (T17 fragment), VNFYAWK (T6 fragment) and SLTTLLR (T11 fragment) were detected in the blood sample taken from RED HOT ASSASSIN prior to race 7, the ATWORTHY PARK SYDNEY DRAFT PACE (2270 metres) conducted at Wagga on Friday 3 March 2023.

The ‘B’ sample was confirmed by Racing Analytical Services Limited (RASL) in Victoria at which time peptide YLLEAK (T4 fragment) was also detected.

Licensed Trainer Mr Greg Fleming was present with his legal representative and provided evidence to the Inquiry. In addition, the Certificates of Analysis and evidence from HRNSW Regulatory Veterinarian Dr Martin Wainscott were presented to the Inquiry.

Mr Fleming pleaded guilty to a charge issued by HRNSW Stewards pursuant to Australian Harness Racing Rule (AHRR) 190 (1), (2) & (4) and he was disqualified for a period of 2 years and 6 months to commence from 2 June 2023, the date upon which he was stood down pursuant to AHRR 183.

Acting under the provisions of AHRR 195, RED HOT ASSASSIN was disqualified from the abovementioned race.

 

23 October 2023– Mr Chris Frisby – HRNSW Stewards conducted an Inquiry in relation to a report from the Australian Racing Forensic Laboratory (ARFL) that Levamisole was detected in the post-race urine sample taken from the horse UNCLE CRAIGO following its win in race 1, the AMBOS STOCKFEEDS MAIDEN PACE (2100 metres) conducted at Young on Sunday 28 November 2021.

The reserve portion and control solution were confirmed by Racing Analytical Services Limited (RASL) in Victoria.

Licensed Trainer Mr Chris Frisby was present and provided evidence to the Inquiry. In addition, the Certificates of Analysis and evidence from HRNSW Regulatory Veterinarian Dr Martin Wainscott were presented to the Inquiry.

Evidence was presented to the Inquiry by Mr Frisby regarding the use of sheep worming drenches on his registered training property that contained levamisole.

Mr Frisby pleaded guilty to a charge issued by HRNSW Stewards pursuant to Australian Harness Racing Rule (AHRR) 190 (1), (2) & (4) and he was disqualified for a period of 8 months to commence immediately.

Acting under the provisions of AHRR 195, UNCLE CRAIGO was disqualified from the abovementioned race.

Mr Frisby has appealed the decision of HRNSW Stewards.

 

24 October 2023– Mr Leon Jurd – HRNSW Stewards conducted an Inquiry in relation to a report from the Australian Racing Forensic Laboratory (ARFL) that flunixin was detected in the pre-race blood sample taken from MELPARK MAGIC prior to race 1, the CHARIOTS OF FIRE 18 FEB TROTTERS MOBILE (1609 metres) conducted at Tabcorp Park Menangle on Tuesday 31 January 2023.

The ‘B’ sample was confirmed by Racing Analytical Services Limited (RASL) in Victoria.

Licensed Trainer Mr Leon Jurd was present and provided evidence to the Inquiry, together with stable employee Mrs Stephanie Morris. In addition, the Certificates of Analysis and evidence from HRNSW Assistant Regulatory Veterinarian Dr Annie Knox were presented to the Inquiry.

Mr Jurd was unable to provide an explanation for the detection of flunixin in the pre-race blood sample taken from MELPARK MAGIC.

Mr Jurd pleaded guilty to a charge issued by HRNSW Stewards pursuant to Australian Harness Racing Rule (AHRR) 190 (1), (2) & (4) and he was disqualified for a period of 3 months to commence immediately.

Acting under the provisions of AHRR 195, MELPARK MAGIC was disqualified from the abovementioned race.

Mr Jurd has appealed the decision of HRNSW Stewards.

 

Appeal Decisions –

3 October 2023– Mr Cameron Ross appealed the decision of HRNSW Stewards to a disqualify him for a period of 10 months and 2 weeks after he pleaded guilty to charge issued pursuant to AHRR 190(1), (2) & (4) and AHRR 196A (1)(ii) & (2) following a report from the Australian Racing Forensic Laboratory (ARFL) that dexamethasone was detected in the post-race urine sample taken MACHS LEGACY following its win in race 5, the MARES SLIPPER PACE (1609 metres) conducted at Newcastle on Friday 10 February 2023.

By decision of the NSW Harness Racing Appeal Panel, the appeal was upheld and a period of disqualification of 7 months was imposed.

Mr Ross has appealed that decision to the NSW Racing Appeals Tribunal and has been granted a Stay of Proceedings.

 

31 October 2023– Mr Darrell Standen appealed the decision of HRNSW Stewards to fine him $750 after pleading guilty to two (2) charges issued pursuant to AHRR 273(6)(a) after the horses ARTISTIC SCOTT and KOZACZYNSKI were both presented to race in the incorrect saddle cloths in Race 10 at Newcastle on Friday 21 July 2023.

By decision of the NSW Harness Racing Appeal Panel, the appeal was upheld and a fine of $375 was imposed.

 

31 October 2023– Ms Olivia Frisby appealed the decision of HRNSW Stewards to suspend her driver’s licence for a period of 4 weeks after she pleaded guilty to a charge issued pursuant to AHRR 149(2) when driving the horse EXCLUSIVE DANCER in Race 5 at West Wyalong on Friday 13 October 2023. By decision of the NSW Harness Racing Appeal Panel the appeal was upheld and the penalty set aside.

 

Integrity Information –

During the month of October 2023, HRNSW Integrity department obtained 858 race day samples.

As per normal HRNSW procedure all samples have been submitted for analysis.
