HRNSW today conducted an inquiry into a report received from Newcastle Harness Racing Club employee Mr Wayne Smith regarding the trial conducted on Wednesday 15 December 2011.
The report from Mr Smith was that after the completion of trial 4, he went and did an identification inspection of the winner, CHASING FREEDOM. After recording the brands, he then checked the horse’s brands, which revealed that the horse which trialled as CHASING FREEDOM was in fact KINGS A COACH.
At today’s inquiry, Trainer Mr S Kilroy pleaded guilty to a charge under Australian Harness Racing Rule 216, in that as the trainer of CHASING FREEDOM he improperly nominated and started in trial 4 at Newcastle on 15 December 2011, a horse purported to be CHASING FREEDOM, when subsequent to the trial upon identification was found to be the registered horse KINGS A COACH.
Mr S Kilroy was disqualified for a period of 2 months,
In considering penalty the Stewards took into account Mr Kilroy’s guilty plea, his period as a licensed person, the seriousness of the offence and his personal circumstances.
Trainer/Driver Mr C Harmey pleaded guilty to a charge under Australian Harness Racing Rule 216, in that he did, on behalf of Trainer Mr S Kilroy improperly nominated, transport and start in trial 4 at Newcastle on 15 December 2011, a horse purported to be CHASING FREEDOM, when subsequent to the trial upon identification was found to be the registered horse KINGS A COACH.
Mr C Harmey was disqualified for a period of 3 months, in considering penalty the Stewards took into account Mr Harmey’s guilty plea, his previous unblemished record, the seriousness of the offence and his personal circumstances.
During the course of the inquiry evidence was tendered regarding the arrangements between Mr Kilroy and Mr Harmey regarding the training of numerous horses located at the Cessnock Showgrounds.
Trainer Mr S Kilroy pleaded guilty to a charge under Australian Harness Racing Rule 245, that he engaged in an improper practice with Mr C Harmey by knowingly representing himself to be the registered trainer of a number of horses trained at the Cessnock Showground since October 2011, when in fact Mr Harmey had care, control and management of those horses and was in fact the trainer.
Mr S Kilroy was disqualified for a period of 6 months effective immediately.
The Stewards ordered that the penalty imposed be served concurrently with the penalty issued for the breach of Rule 216. In assessing penalty Stewards were mindful of the forthright evidence tendered by Mr Kilroy, his guilty plea, his record during his 27 years as a licensed person and the serious nature of the offence.
Trainer/Driver Mr C Harmey pleaded guilty to a charge under Australian Harness Racing Rule 245, that he engaged in an improper practice with Trainer Mr S Kilroy, by knowingly arranging for him to represent himself as the registered trainer of a number of horses that were in fact, being cared for and trained by Mr Harmey from the Cessnock Showgrounds since October 2011.
Mr C Harmey was disqualified for a period of 6 months effective immediately.
The Stewards ordered that the penalty imposed be served concurrently with the penalty issued for the breach of Rule 216. In assessing penalty Stewards were mindful of his forthright evidence, his guilty plea, the circumstances of the offence, his record during his 15 years as a licensed person and the serious nature of the offence.
