Trainer Mr. Andrew McIntosh pleaded guilty to a charge under Rule of Racing 190 (1),(2) & (4) in that as the trainer SHARPE FALCON he did present that horse to race in race 5, the Village Jasper Pace at the Menangle meeting on Wednesday, 10 August, 2011 when a blood sample taken from it prior to the race upon analysis revealed a Total Plasma Carbon Dioxide level above the threshold.
The Stewards relied upon Rule of Racing 191 (1) & (3) in determining the charge against Mr. McIntosh as the second certificate from Racing Analytical Services Limited report at level at 37.0mmol/L.
Mr McIntosh was disqualified for a period of 4 months effective immediately.
In considering penalty stewards took into account that this charge was based upon a prima facie evidence relating to the first certificate, his previous good record and his guilty plea.
SHARPE FALCON was disqualified under Rule of Racing 195 from the above mentioned race.
