Stewards’ Report – Kristin Cunningham

The Queensland Racing Integrity Commission (QRIC) Stewards today conducted an inquiry into a report received from the Queensland Government Racing Science Centre (RSC) that Dexamethasone was detected in a urine sample taken from Roarn following its winning performance in Race 9, the Qbred Triad Consolation – 3YO Colts & Geldings at Albion Park on 28 May 2016 and in a pre race urine sample taken prior to Roarn competing in Race 5, The Redcliffe Derby at Redcliffe on 3 June 2016.
Evidence was provided via a telephone conference from the registered trainer of Roarn, Kristin Cunningham, and Daniel Rowell, the person in charge of Roarn when it was presented for racing at Albion Park on 28 May and at Redcliffe on 3 June 2016. Evidence was also provided by Dr Karen Caldwell, Acting Manager Veterinary Services, and Samantha Nelis, Acting Manager Analytical Services, from the Racing Science Centre.
After consideration Ms Cunningham was charged pursuant to Australian Harness Racing (AHR) Rule 190 (1) which reads:
190. (1) A horse shall be presented for a race free of prohibited substances.
(2) If a horse is presented for a race otherwise than in accordance with sub rule (1) the trainer of the horse is guilty of an offence.
(3) If a person is left in charge of a horse and the horse is presented for a race otherwise than in accordance with sub rule (1), the trainer of the horse and the person left in charge is each guilty of an offence.
(4) An offence under sub rule (2) or sub rule (3) is committed regardless of the circumstances in which the prohibited substance came to be present in or on the horse.

The particulars of the charge being that Ms Cunningham did present Roarn for racing at Albion Park on 28 May 2016 and Redcliffe on 3 June 2016 when a subsequent analysis of urine samples obtained from that horse detected the presence of the prohibited substance Dexamethasone.
Ms Cunningham was found guilty of the charge and fined the sum of $6000.
Further, as the person in charge of Roarn at the relevant times, Daniel Rowell was charged pursuant to AHR Rule 190(1) which reads:
190. (1) A horse shall be presented for a race free of prohibited substances.
(2) If a horse is presented for a race otherwise than in accordance with sub rule (1) the trainer of the horse is guilty of an offence.
(3) If a person is left in charge of a horse and the horse is presented for a race otherwise than in accordance with sub rule (1), the trainer of the horse and the person left in charge is each guilty of an offence.
(4) An offence under sub rule (2) or sub rule (3) is committed regardless of the circumstances in which the prohibited substance came to be present in or on the horse.

Stewards directed that Roarn be disqualified from its first placing in the Qbred Consolation at Albion Park on 28 May 2016 and its second placing in the Redcliffe Derby at Redcliffe on 3 June 2016 under the provisions of AHR Rule 195. All other placegetters were amended accordingly.
The embargo placed on Roarn restricting the horse from racing was lifted.
Ms Cunningham and Mr Rowell were advised of their rights to internal review.
