Mr Barry Lew - Inquiry Concluded

HARNESS Racing New South Wales  conducted an inquiry in 2012-2013 into a report received from ARFL that the substance norketamine was detected in a post race urine sample taken from KARLOO MICK following its win of Race 4 Garrards Pty Ltd Pace at Menangle Park on 13 October 2012.

The “B” sample was confirmed by RASL in Victoria.

Mr Lew presented evidence of his good husbandry practices and compliance with Australian Harness Racing Rules.

Mr Lew presented to HRNSW expert evidence to the effect that the result was probably due to an unintentional environmental contamination.

In issuing no penalty against Mr Lew, HRNSW accepted on the balance of probabilities that the norketamine detected in the urine sample was due to an unintentional environmental contamination.

In determining to record no conviction, HRNSW took into account the lack of utility of Mr Lew’s appeal continuing to be contested.

Industry participants are reminded that high husbandry practices are required even when using premises registered to other trainers and that exceptional circumstances were specific to this case.
