The Court of Appeal today made preliminary orders in relation to a Notice of Motion and Appeal filed by Neil Day and Dean McDowell against the decision of Justice Adamson of 14 October 2014 in the NSW Court of Appeal. The appeal hearing has been set down for Tuesday, 18 November 2014
The Court of Appeal granted injunctions against HRNSW and Stewards from proceeding with the inquiries which had been notified to each of Mr Day and Mr McDowell on 15 August 2014, pending the resolution of their Appeal proceedings.
The terms of the injunction also provide that Mr Day and Mr McDowell be restricted from all activities in the industry until resolution of the Appeal; for an amount of security for costs to be provided; and that the hearing of the Appeal be expedited if possible. The suspensions advised to them of 30 April 2014 remain in place, as well as some additional restrictions which have been agreed to by Mr McDowell and Mr Day as part of the terms of the injunction.
The orders that were made today had been agreed between both parties prior to the court ordering the injunction today.
