HRNSW today continued an inquiry that was opened at Tabcorp Park Menangle on Sunday 28 April 2013, into the notified change of tactics for MACH ALERT NZ in the SEW Eurodrive Miracle Mile and the subsequent driving tactics by Mr John McCarthy.

At the previous inquiry on Monday 6 May 2013, Mr J McCarthy was issued with a charge pursuant to Rule 44(3), in that as the driver of MACH ALERT NZ he failed to drive that horse in accordance with the approved change of tactics as notified to the Stewards by Trainer Mrs B McCarthy.

Further evidence was today taken from Mr Anthony Butt and Mr Dan Mielecki.

Stewards adjourned the inquiry to a date to be fixed as they wish to further investigate some evidence tendered at the inquiry on Monday 6 May 2013 and re-question trainer Mrs B McCarthy.

Relevant Australian Harness Racing Rules:
44. (1) A driver or 1 or more of the connections of a horse intending to adopt during a race tactics contrary to the horse’s usual racing pattern shall, as soon as practicable, so notify the Stewards.
(2) The Stewards may approve or disapprove the change of tactics.
(3) In the event of the Stewards approving a change of tactics, then in the absence of exceptional circumstances, the horse shall be driven in accordance with the approved change.
(4) A person who fails to comply with sub rules (1) or (3) or changes tactics without approval given under sub rule (2) is guilty of an offence.
