Trainer Mr Jarrod Alchin – positive swabs

Harness Racing NSW yesterday concluded the inquiries into reports from the Australian Racing Forensic Laboratory (ARFL) that capsaicin had been detected in the post race urine samples taken from:

1. LIVING LORD NZ after it raced and won Race 5 the Camarda & Cantrill Pace (1609 metres) at Tabcorp Park Menangle on 13 November 2012.
2. IN NO MANS LAND NZ after it raced and won Race 4 the Australian Weighing Equipment Pace (Christmas Gift Heat Three) (1,609 metres) at Tabcorp Park Menangle on 8 December 2012
3. LIVING LORD NZ after it raced and won Race 5 the Wadwell Grain & Stock Feeds 50th Inter City Pace Heat Two (2,422 metres) at Maitland on 30 December 2012.

These findings have been confirmed by the Hong Kong Jockey Club Laboratory and Racing Analytical Services Laboratory (RASL) (Melbourne).

Evidence was taken from Mr Jarrod Alchin, trainer of LIVING LORD NZ and IN NO MANS LAND NZ and HRNSW Regulatory Veterinarian Dr Martin Wainscott. Lawyer Mr Mathew Hammond was granted Stewards leave to represent Mr Alchin.

Mr Alchin pleaded guilty to the following charges under AHRR 190 (1) (2) and (4):

1. For presenting LIVING LORD NZ to race at Tabcorp Park Menangle on 13 November 2012 not free of the prohibited substance capsaicin
2. For presenting IN NO MANS LAND NZ to race at Tabcorp Park Menangle on 8 December 2012 not free of the prohibited substance capsaicin
3. LIVING LORD NZ to race at Maitland on 30 December 2012 not free of the prohibited substance capsaicin

In considering penalty the Stewards took into account the following:
• Mr Alchin’s guilty pleas
• Mr Alchin’s blemish free record for breaches of the prohibited substances rules since being licensed over approximately 9 years
• Mr Alchin’s personal circumstances
• HRNSW Prohibited Substance Penalty Guidelines

The following penalties were handed down:
1. Charge 1 - six (6) months disqualification effective immediately
2. Charge 2 - nine (9) months disqualification effective immediately
3. Charge 3 - nine (9) months disqualification effective immediately

Stewards directed that all terms of disqualification are to be served concurrently.

Acting under the provisions of AHRR 195 Stewards ordered the following:

1. That LIVING LORD NZ be disqualified as the winner of Race 5 the Camarda & Cantrill Pace (1609 metres) at Tabcorp Park Menangle on 13 November 2012 and the placings amened to:

1st EDUCATED LADY (D J Thorn)
2nd BIEN HOA NZ (G Tanti)
3rd FLYING CAMERON (K A Turner)
4th IM GEORGE W NZ (C A Butt)

2. That IN NO MANS LAND NZ be disqualified as the winner of Race 4 the Australian Weighing Equipment Pace (Christmas Gift Heat Three) (1,609 metres) at Tabcorp Park Menangle on 8 December 2012 and placings amended to:

1st SCARRYMCLEARY NZ (D J Thorn)
2nd SATELLITE ACE (K A Turner)
3rd OUR MELS DREAM NZ (M P Rue)
4th COURAGE TELLS NZ (A M Siejka)

3. That LIVING LORD NZ be disqualified as the winner of Race 5 the Wadwell Grain & Stock Feeds 50th Inter City Pace Heat Two (2,422 metres) at Maitland on 30 December 2012and placings amended to:

1st DYNAMITE DENN NEE NZ (B P Fitzpatrick)
2nd BIEN HOA NZ (G Tanti)
3rd WESTERN DESTROYER (J N Douglas)
4th MY LADY OF THE NIGHT NZ (M C Muscat)


Further, as the races in relation to IN NO MANS LAND NZ (Race 4 the Australian Weighing Equipment Pace (Christmas Gift Heat Three) (1,609 metres) at Tabcorp Park Menangle on 8 December 2012) and LIVING LORD NZ ( Race 5 the Wadwell Grain & Stock Feeds 50th Inter City Pace Heat Two (2,422 metres) at Maitland on 30 December 2012) were Heats going into a Final, pursuant to AHRR 195A, IN NO MANS LAND NZ was disqualified from third place in the Camarda & Cantrill Christmas Gift Final (Group 3) (1,609 metres) at Tabcorp Menangle Park on 22 December 2012 and the placings amended to:

1st IM ON TARGET NZ (L A McCarthy)
2nd MANTOMAN (J J Alchin)
3rd EXCITEUSINTHECITY (D R Hancock)
4th AMERCICAN MUSCLE (G R Sugars)

Also, LIVING LORD NZ was disqualified as fourth (4th) placegetter in the Maitland Sheet Metal 50th Inter City Pace Final (Group 2) (2,422 metres) at Maitland on 5 January 2013 and placings amended to:

1st SCANDALMAN (J N Douglas)
2nd MAJOR POST (S P Robinson)
3rd BEETSON (T G Rue)
4th GOTTA FEELING (P G Hedges)


The embargoes previously placed on LIVING LORD NZ and IN NO MANS LAND NZ under the provisions of AHRR 183A, were lifted.
