On 1 May 2019, licensed trainer Jeff Tabone lodged an application for review with the Victorian Civil and Administrative Tribunal (VCAT) regarding a decision of the Harness Racing Victoria (HRV) Racing Appeals and Disciplinary (RAD) Board to disqualify him for three years. Mr Tabone sought a stay of proceedings, which was opposed by the HRV Stewards.
On 29 May 2019, VCAT Senior Member Gerard Butcher considered submissions from Richard Ingleby, on behalf of Mr Tabone, and Adrian Anderson, on behalf of HRV, in relation to the stay application.
At the conclusion of that hearing, Senior Member Butcher dismissed the stay application of Mr Tabone, determining that in these circumstances the interests of upholding the integrity of the harness racing industry, outweigh the personal interests of Mr Tabone. Mr Tabone remains disqualified until such time as his application for review is determined by VCAT.
