NSWLR115. This Part applies to betting at race meetings and to the extent that it is not inconsistent or repugnant to the context also to betting at Betting Auditoriums or other locations where bookmaking may legally be conducted.Control Of Forms Of Betting NSWLR116. (1) Bets with bookmakers must be for a win, or win and place, unless otherwise approved by the Controlling Body. (2) Bets shall be paid in respect of a race according to the placings existing at the time all clear is declared by the All clear Steward. Bets Off NSWLR117. Bets are off and any stake paid shall be returned to the investor in the following circumstances - (a) if the bet is made on the course on the day of the race on a horse which is not a starter; (b) in the case of a match race if either horse is not a starter; (c) if the bet is made on the course on the day of the race and the race is subsequently postponed to another day, or is ordered by the stewards to be rerun or restarted on another day, or is abandoned. NSWLR118. (1) If a horse is declared a non starter in a race or if there is a late withdrawal of a horse from a race, bets on such a horse may be declared off by the stewards.(2) Where the stewards act under sub rule (1) they may make such declarations and orders with respect to betting on the race as they think fit, including an order that payment of winning and place bets made before the stewards acted under sub rule (1) be subject to a deduction in accordance with the scale approved by the Controlling Body. (3) In the event of a late withdrawal when betting is taking place the stewards may make orders for the settlement of quinella bets as follows: (a) If the favourite horse with which the other runners have been laid is withdrawn, all quinella bets made before the announcement of the late withdrawal shall be off and any stake paid shall be returned to the investor; (b) If any other horse is withdrawn, the bets in which that horse has been joined with the favourite horse shall be off and the stake shall be returned to the investor and the quinella bets in which the favourite horse has been joined with other remaining runners made before the announcement of the late withdrawal shall be subject to a deduction in accordance with the scale approved by the Controlling Body. (4) If a bet is made at a course in respect of a race to be run elsewhere and there is a late withdrawal from that race, the bet shall be settled in accordance with the order of the stewards at the course where the race is run. (5) An order made under sub rule (4) may include an order that bets be settled in accordance with the principles set out in these rules. (6) If through the application of this rule an investor would get less than the investors stake, the stewards may declare all bets off and call for fresh betting. (7) If after betting on a race has commenced on the course, and before all clear has been declared, something happens which in the opinion of the stewards could materially affect betting, they may make such declarations and orders as to betting on that race as they think fit, including declaring all bets off and calling for fresh betting. NSWLR119. (1) If, in the opinion of the stewards, bets have been or may have been affected by fraud or corrupt practice, they may declare the bets off. (2) In the event of a race being rerun all bets are off. (3) Any bet made on a horse entered for 2 events on the same day shall refer to the first race in which the horse starts, provided if this is a walk over the bet is off. (4) Bets shall not be made on the result of a race after the judge has called for a photograph or after a protest has been lodged. Dead Heats NSWLR120. (1) In the event of a dead heat for first place the successful investors shall receive one half the face value of the tickets. (2) If 2 horses are backed to run first and second irrespective of order, and 1 horse so backed wins and the other runs a dead-heat for second the successful investors shall receive one half the face value of the tickets. (3) Where more than 2 horses run a dead heat in the circumstances described in sub rule (1) or sub rule (2), the investor shall be paid an amount that is equal to the sum of the face value of the tickets divided by the number of horses dead heating. (4) In relation to place betting on races in which bets on the horses finishing first, second and third are payable in accordance with rule 122 and rule 124(1) - (a) If 4 or more horses dead heat for first place, the investor shall be paid an amount that is equal to 3 times the sum of the face value of the tickets divided by the number of horses dead heating; (b) If 3 or more horses dead heat for second place, the investor shall be paid an amount that is equal to twice the sum of the face value of the tickets divided by the number of horses dead heating; and (c) If 2 or more horses dead heat for third place, the investor shall be paid an amount that is equal to the sum of the face value of the tickets divided by the number of horses dead heating. (5) In relation to place betting on races in which bets on the horses finishing first and second are payable in accordance with rule 123 and rule 124(2) -(a) If 3 or more horses dead heat for first place, the investor shall be paid an amount that is equal to twice the sum of the face value of the tickets divided by the number of horses dead heating; and (b) If 2 or more horses dead heat for second place, the investor shall be paid an amount that is equal to the sum of the face value of the tickets divided by the number of horses dead heating. Doubles Betting NSWLR121. (1) In doubles betting -(a) bets are determined when the first event is lost; (b) if either event is decided in the investors favour and the other event is dead heated, the investor shall receive half the face value of the ticket; (c) if both horses backed run dead heats, the investor shall receive one quarter of the face value of the ticket. (2) In the absence of any stipulation to the contrary and subject to sub rule (3), doubles bets stand though 1 or both horses do not start. (3) In respect of doubles bets made on course on the day on which both events are set to run - (a) bets are off and any investment is refundable if the horse backed in the first event is not a starter; (b) if the horse backed in the first event wins and the horse backed in the second event is not a starter, the investor shall be paid at the starting price odds of the winner of the first event; (c) if both events are postponed to another day the investment shall be returned to the investor;(d) if 1 event of a double is decided and the second event is postponed to another day, the double shall be terminated and the backers of the winner of the first event shall be paid at the starting price odds of the winner of that event. Each Way Betting NSWLR122. Where a bet is placed as an each way bet and -(a) there were 8 or more horses in the race when the bet was made, the place component of the bet shall be paid by the bookmaker on the horses placed first, second and third at one quarter of the odds for the win bet on the horse backed at the time all clear is declared, subject to any deduction directed by the stewards; (b) there were 5, 6 or 7 horses in the race when the bet was made, the place component of the bet shall be paid by the bookmaker on the horses placed first and second at one third of the odds for the win bet on the horse backed at the time all clear is declared, subject to any deduction directed by the stewards. Place Only Betting NSWLR123. Where place only betting is permitted a bookmaker may accept bets at such odds as he may determine and shall pay accordingly subject to any deduction directed by the stewards - (a) where there were 8 or more horses in a race when the bet was made, on the horses placed first, second and third; (b) where there were 5, 6 or 7 horses in the race when the bet was made, on the horses placed first and second. Quinella Betting NSWLR124. (1) Where quinella betting is permitted, a bookmaker shall bet against any 2 horses in the same race and shall pay on the winning ticket so long as the 2 horses fill first and second places irrespective of their finishing order. (2) In the event of a late scratching being odds on at the time of its withdrawal, all quinella bets on the race are off and all investments are to be refunded. (3) In the event of 1 of the nominated horses in a quinella being even money or longer at the time of its withdrawal, all quinella bets incorporating the withdrawn horse are off and all investments are to be refunded. (4) Winning bets made before the withdrawal of a horse described in sub rule (3) shall be subject to a deduction in accordance with the scale of deductions for quinella betting. Qualification On Obligation To Pay Bet NSWLR125. A Bookmaker is not obliged to pay a bet if - (a) a period of 3 months has elapsed since the date of the bet; and (b) the bet has been paid to a claimant and there were reasonable grounds for believing the claim to be genuine. Betting Limits NSWLR126. (1) A bookmaker carrying on business at a meeting must accept bets within the monetary limits determined by the club or other body conducting the meeting, subject to the approval of those limits by the Controlling Body. (2) If monetary limits are not determined and approved pursuant to sub rule (1), they shall be determined by the Controlling Body. (3) A bookmaker may accept bets exposing the bookmaker to a liability greater than that fixed under this rule, unless the Controlling Body directs otherwise. Betting Disputes NSWLR127. (1) A dispute relating to betting shall be determined by the stewards who may delegate their authority in that behalf to a betting supervisor. (2) Notwithstanding delegation of authority under sub rule (1) the stewards may determine betting disputes, including ones ruled on by a betting supervisor. Registration NSWLR128. (1) A person of or above the age of 18 years may in the manner and form determined by the Controlling Body, make application to the Controlling Body for registration as a bookmaker or a bookmakers clerk.(1)(a) A Proprietary Company may in the manner and form determined by the Controlling Body, make application to the Controlling Body for registration as a Bookmaker. (2) An application shall be accompanied by such documentation, information, fees, cash deposit, guarantee or other type of security as the Controlling Body may determine. (3) The Controlling Body may grant registration upon such terms and conditions as it thinks fit. (4) Registration remains in force for the period determined by the Controlling Body. (5) Registration may be refused by the Controlling Body without assigning any reason. (6) Registration may be cancelled by the Controlling Body for breach of a term or condition of registration. NSWLR129. (1) The provisions of these rules relating to bookmakers and bookmakers clerks are to be read subject to the terms and conditions imposed on grant of registration under rule 128. (2) In the event of a conflict between a provision of these rules and a term and condition imposed on grant of registration, the obligation of the bookmaker or clerk is to comply with the term and condition. Standards Required Of Bookmakers NSWLR130. (1) A bookmaker shall - (a) at a meeting observe the standards of dress and conduct required by the Controlling Body; (b) personally conduct all betting transactions with members of the public unless authorised otherwise by the stewards; (c) bet on every race at a meeting unless authorised otherwise by the stewards; (d) commence betting at a reasonable time before the advertised starting time of the first race, or at such other time as directed by the stewards; (e) commence betting at a reasonable time after all clear has been notified for the previous race, or at such other time as directed by the stewards; (f) remain on the stand until a reasonable time before the start of a race; (g) display odds for every runner in a race; (h) before leaving the course hand to the betting supervisor a written return containing full details of all unclaimed winning cash wagers; (i) carry on the business from the stand allotted to the bookmaker for that purpose; (j) a bookmaker or a bookmaker company may only trade or operate under a name which is registered and has been approved by HRA NSW. Such approved name shall be displayed at all times on the bookmaker's stand, betting sheets, betting tickets, activity return forms and any other correspondence during the term of the licence; (k) subject to any direction by the stewards, draw a line beneath the last bet recorded on the betting sheets on each contestant in a race, immediately a late withdrawal is announced after betting has commenced on the race; (l) use betting boards of a specified type; (m) produce on demand to the betting supervisor, the stewards, or authorised person, authority from the Controlling Body to carry on a bookmaking business and bookmakers tax receipt; (n) field only for himself or herself and for no one else, or in the case of a Proprietary Bookmaker Company, field only for that Company; (o) when fielding at a meeting engage in no business or activity other than the conduct of a bookmaking business; (p) settle bets immediately on presentation of winning tickets, unless the bookmaker has reason to suspect that the person presenting the ticket is not the bona fide ticket holder; (q) immediately report to the betting supervisor or the stewards, details of any bets not settled; (r) comply with any request or direction of the betting supervisor, the stewards or authorised person; (s) make genuine bets only; (t) notify the Controlling Body of any change of address or any change in some other particular specified by the Controlling Body. (u) upon making any bet, including a bet made as a layer, backer and when betting back, immediately record the bet in a legible manner in the authorised betting book, records or sheets; provided that such record of any such bet must identify with whom the bet was made. (2) A bookmaker who fails to comply with any provision of this rule is guilty of an offence. NSWLR131. (1) A bookmaker shall not -(a) engage in, or participate in the conduct of, illegal betting or in any way assist persons to do so; (b) except as authorised by law or with the permission of the Controlling Body, directly or indirectly transmit information concerning betting odds or transactions to a person outside the course where a meeting is being conducted; (c) employ or avail himself of the services of any person in the capacity of a runner or signaller; (d) except with the permission of the Controlling Body, employ or engage anyone at a meeting in or about the conduct of the bookmakers business other than a registered bookmakers clerk; (e) when fielding at a meeting, enter the birdcage or stable area, or communicate in any way with a driver, unless permission to do so has been given by the stewards; (f) when fielding at a meeting place bets on a horse except for the purpose of reducing the liability in respect of bets already laid against a particular horse; (g) enter, or permit to be entered, fictitious, misleading or fraudulent particulars in the betting sheets; (h) except as authorised by law or with the permission of the Controlling Body, communicate in any way with a person outside the course, or accept any bet in any way transmitted from outside the course. (2) A bookmaker who fails to comply with any provision of this rule is guilty of an offence. Standards Required Of Clerks NSWLR132. (1) A bookmakers clerk shall - (a) at a meeting observe the standards of dress and conduct required by the Controlling Body; (b) produce on demand to the clerks employer, the betting supervisor, the stewards, or authorised person, authority from the Controlling Body to work as a bookmakers clerk; (c) confine his or her activities at a meeting to working for the clerks employer in the conduct of bookmaking; (d) at a meeting, work for one employer only unless the stewards permit otherwise. (2) A bookmakers clerk who fails to comply with any provision of this rule is guilty of an offence. NSWLR133. (1) A bookmakers clerk shall not - (a) do any of those things prohibited to a bookmaker by paragraphs (a), (b), (e), (g) and (h) of rule 131; (b) when working at a meeting place bets on a horse other than in the course of the clerks employment; (c) act as a runner or signaller to transmit betting information from 1 place to another; (d) unreasonably inconvenience persons when moving to or from the betting stand of the clerks employer; (e) call the odds, adjust betting boards, or write tickets on behalf of the employer, except with the permission of the Controlling Body. (2) A bookmakers clerk who fails to comply with any provision of this rule is guilty of an offence. Betting Sheets And Tickets NSWLR134. (1) A bookmaker shall in connection with the bookmakers business as required by law and in the manner and form and with the information and particulars required by the Controlling Body - (a) keep or cause to be kept betting sheets; (b) issue or cause to be issued betting tickets. (2) A bookmaker who fails to comply with any provision of this rule is guilty of an offence. Absence From Business NSWLR135. (1) If a bookmaker is unable because of sickness, accident or some other cause acceptable to the Controlling Body to carry on bookmaking business at a meeting, a bookmaker or a bookmakers clerk may with the permission of the Controlling Body carry on that business. (2) Permission granted under sub rule (1) shall be on the terms and conditions imposed by the Controlling Body. (3) Subject to sub rule (2) all provisions of these rules relating to bookmakers apply to a person granted permission under this rule in the conduct of the business. Offences NSWLR136. (1) Subject to rule 135, a person who carries on the business of a bookmaker, or acts as a bookmaker, at or in connection with any meeting or race without being registered under rule 128 or in breach of a term or condition of registration is guilty of an offence. (2) A person who acts as a bookmakers clerk, or is employed or engaged as or in effect as such a clerk, at or in connection with any meeting or race without being registered under rule 128 or in breach of a term or condition of registration is guilty of an offence. (3) A bookmaker who directs, persuades or encourages a bookmakers clerk to breach a term or condition of the clerks registration under rule 128 is guilty of an offence. NSWLR137. Unless otherwise determined by the Controlling Body the scale of deductions for late withdrawals shall be: (a) Scale of deductions for late scratchings for win only and traditional each way betting.
NSWLR137. (b) Scale of deductions for late scratchings for place betting
NSWLR138. Bookmakers who have been issued with the relevant telephone betting authority by the Minister for Gaming and Racing may conduct telephone betting subject to the provisions of the Racing Administration Act 1998, and any conditions imposed by the Minister under the Act, and subject to such conditions as imposed from time to time by HRA. (new NSWLR138 approved 3.9.04) NSWLR139. A Bookmaker or Bookmaker's Clerk must not, without the permission of the stewards, whilst betting is taking place on a racecourse, bring on to, have in his or her possession, or use any portable telephone, radio transmitter, radio transceiver, or other appliance, apparatus instrument or equipment capable of receiving or transmitting information that has not been approved under an authority issued by the Minister for Gaming and Racing. (new NSWLR139 approved 3.9.04) NSWLR140. Any bets placed by a Bookmaker via telephone during a race meeting upon which he or she is conducting his or her business as a Bookmaker, must only be with a Bookmaker operating at another registered race meeting, licensed betting auditorium, or sports betting office within Australia. Such bets may only be for the express purpose of reducing the liability on bets already laid by the Bookmaker, upon such events on which he or she is currently fielding. Full details of the transaction, including the name of the Bookmaker with whom such bet is made, must be recorded separately.
