Stewards Inquiry – Noel Tyndall
Harness Racing Victoria (HRV) Stewards have today concluded inquiries into a stable inspection conducted by stewards on 2 May 2017 at the property of Mr Noel Tyndall. The stable inspection was conducted on the first day following a three year disqualification served by Mr Tyndall from Harness Racing New South Wales (HRNSW).
As a result Mr Tyndall pleaded guilty to a charge under ARHR 91(1)(a) for carrying on activities regulated by licence when not the holder of a current licence. The particulars being that on 2 May 2017 Mr Tyndall was observed exercising three registered horses on his property when not the holder of a current licence. After taking into account Mr Tyndall’s guilty plea, co-operation throughout the investigation and the need for consistency of penalty he was fined $200.
Whilst being interviewed regarding the above matter Mr Tyndall made admissions regarding the transportation of three registered horses to a nearby property towards the end of his disqualification period. Mr Tyndall subsequently pleaded guilty to a charge under ARHR 259(1)(h) for participating in the harness racing industry whilst a disqualified person. The particulars being that approximately 6 weeks prior to the stable inspection conducted by stewards on 2 May 2017 Mr Tyndall has transported three registered horses to a nearby property before transporting the horses back to his property approximately 3 weeks later, thereby participating in the harness racing industry. During this relevant time, Mr Tyndall was serving a disqualification imposed by HRNSW. In considering penalty stewards took into account Mr Tyndall’s guilty plea, his co-operation throughout the investigation and the circumstances which are considered to be at the lower end of offending in relation to this rule. Mr Tyndall was fined the sum of $1000 of which, $500 is suspended for a period of 12 months.
