RACE 5 – MOAMA BOWLING CLUB PACE
Stewards concluded an inquiry into the tactics adopted by driver David Moran on Showgun Thomas and for his reasons to switch to the marker pegs to trail the leader Rocknchaton with 500m to travel which resulted in Midnitedelite, which was trailing Showgun Thomas originally, obtaining a clear run to progress through and obtain an advantage over Showgun Thomas before ultimately that gelding switched from behind the leaders back rounding the final turn to run on strongly, beaten narrowly into second placing. Stewards originally adjourned the inquiry to assess the evidence provided and also to analyse all betting activity relevant to this particular race. Upon examination, the information provided by the wagering service providers failed to reveal any betting activity outside the normal parameters with no suspicious activity detected. In assessing the driving tactics adopted by Mr Moran stewards felt that he had erred by switching from the one wide line to trail the leader leaving the 500m however could not be satisfied that this actions had an overall bearing on the outcome of the race. Stewards were further satisfied that the decision of Mr Moran was not pre-empted and made at the time the opportunity immediately arose and therefore when giving consideration as to whether a charge should be preferred against the driver stewards were mindful of the degree of culpability that ought to be placed upon him in such circumstances and the standard of proof required to sustain a charge therefore the benefit of the doubt was given to Mr Moran and stewards refrained from issuing a charge under the provisions of AR 149. Mr Moran was further advised he is to ensure that his decision making in races is at such a level which does not bring him under question from the stewards.
