HRSA Stewards finalised an inquiry into the circumstances surrounding driver Clinton Fuller failing to provide a urine sample, after being directed to do so by stewards, at the Globe Derby race meeting on Monday 27 July 2015. After leaving the course and failing to provide a sample on that day, Clinton Fuller was immediately stood down from driving.
At the inquiry, evidence was taken from Clinton Fuller, Mrs Sheath and Jonathon Kingston-Mayne regarding the personal circumstances of Mr. Fuller and the events leading up to the race meeting of 27 July 2015.
Clinton Fuller pleaded guilty to a charge under Rule 250(1)(b) which reads:
A driver commits an offence if:-
he refuses or fails to deliver a sample as directed by the Stewards, or tampers with or in any way hinders the collection of such sample.
In determining penalty stewards were mindful that Clinton Fuller had no previous drug of abuse offences, the need for any penalty to act as a deterrent, both specific and general and the individual circumstances of this case. Clinton Fuller had his licence to drive in races suspended for 4 months, backdated to the date he was stood down from driving, 28 July 2015.
