Harness Racing NSW commenced an inquiry today into a report received from the Australian Government National Measurement Institute that cobalt above the threshold was detected in a post race urine sample taken from CAPTAIN COONEY following its win in race 6, the Karas Smash Repairs Pace (1609 metres) conducted at Menangle on 12 May 2014.
The “B” sample and associated control sample were confirmed by the ChemCentre in Western Australia.
Mr Kelly appeared at the inquiry. Evidence including the Reports of Analysis, expert evidence from Harness Racing NSW Regulatory Veterinarian Dr Wainscott and a Stable Inspection Report was presented at the inquiry. Evidence was also taken from Mr Kelly regarding the training of CAPTAIN COONEY, his husbandry practices, items located at his stable during the Stable Inspection and compliance with the Australian Harness Racing Rules.
Charges have been issued against Mr Kelly pursuant to Australian Harness Racing Rules 190 (1), (2) and (4) and Rule 194. Mr Kelly entered pleas of Not Guilty and made application for an adjournment to seek legal advice which was granted.
The inquiry has been adjourned until 10am on Monday 22 September 2014.
