Tabcorp Park Melton– 30 January 2021

RACE 6- ALLIED EXPRESS CASEY CLASSIC (GROUP 2) (2240 MS

Chris Frisby, trainer of Our Uncle Sam advised subsequent to the event the gelding has recovered and worked satisfactorily since with blood tests failing to reveal any significant abnormalities, Mr Frisby is at a loss to explain the performance. Our Uncle Sam is engaged at Tabcorp Park Melton 6th February 2021.

Emma Stewart, trainer of Always Fast advised subsequent to the event the entire has recovered well and has been given a light week. Ms Stewart attributed the performance to Always Fast having consistently racing over recent weeks.

Geoff Webster, trainer of Majestic Cruiser advised subsequent to the event the entire has recovered and worked satisfactorily since. Mr Webster attributed the performance to Majestic Cruiser constantly chasing throughout a fast first lap. Majestic Cruiser is engaged at Tabcorp Park Melton 6th February 2021.

RACE 5 – RICHMOND & ASSOCIATES WEDDERBURN TROTTERS CUP (2955 SS)

Emmett Brosnan, Co trainer of Mah Mukker advised subsequent to the event the gelding has recovered well with blood tests failing to reveal any significant abnormalities. Mr Brosnan advised it will now be the stables intention to give Mah Mukker a slight let up from racing before continuing with the preparation.

RACE 3 – CLAIRE WESTON PHOTOGRAPHY- KERRYN MANNING PACE (2200 MS)

Shannon Edwards, trainer of Security Check advised subsequent to the event the gelding underwent an endoscopic examination which revealed Security Check displaying low grade mucous. Mr Edwards advised the gelding will now be placed on a course of antibiotics.

Emma Stewart, trainer of Exalted Figure advised subsequent to the event the gelding has recovered satisfactorily. Ms Stewart attributed the performance to the gelding being driven more forward from the start and it will now be the intentions to drive the gelding more conservatively at the start in the immediate future.

Tabcorp Park Melton– 30 January 2021

Licensed trainer/driver Robert Colquhoun pleaded guilty to a charge under Rule 248 which states:

A person shall not say, publish or write or cause to be said, published or written anything malicious, intimidatory, obscene, offensive, defamatory, racist, threatening, harassing, discriminatory, abusive or otherwise improper about the Controlling Body, its members and employees or the Stewards or anyone else associated with the Harness Racing Industry.

The particulars of the charge being that on or about 29 January 2021, via a facebook account held in his name, he published inappropriate comments regarding the Maryborough Harness Racing Club Committee.

In assessing penalty Stewards took into account Mr Colquhoun’s guilty plea, his clear industry record over 20 years and that the usual penalties under this particular rule involve the imposition of a fine.  Stewards accordingly imposed a $1000 fine with half of the penalty suspended for a period of 12 moths providing Mr Colquhoun does not reoffend under the conduct related rules during that period.

Mr Colquhoun was advised of his rights of appeal.

Race 3- TAB LONG MAY WE PLAY 3YO & OLDER PACE (2190 MS)

Stewards today concluded an inquiry into the tactics adopted by James Herbertson on Treacherous Rock throughout the event.

This matter was previously adjourned to allow stewards to review the recent racing performances of Treacherous Rock and also to conduct an analysis of all betting transactions on the event, where upon analysis of the betting transactions, stewards were satisfied that there was no area of concern in relation to the wagering on this event.

After taking further evidence from Mr Herbertson and further review of the available replays. Mr Herbertson was found guilty of a charge under AHR Rule 149 (1) which states:

A driver shall take all reasonable and permissible measures during the course of a race to ensure that the horse driven by that driver is given full opportunity to win or obtain the best possible placing in the field.

The particulars of the charge being that on two (2) separate occasions throughout the event Mr Herbertson had both reasonable and permissible opportunities to direct Treacherous Rock away from a marker line position.

Shortly after being crossed at the start Mr Herbertson failed to direct Treacherous Rock away from a marker line position into a running line position when an opportunity presented from approximately the 2000m to the 1800m.

Mr Herbertson had a further opportunity to restrain and direct Treacherous Rock to a running line position following Lilbitahenrytee, from approximately the 500m to the 300m which would have afforded Treacherous Rock the opportunity to a clear and unimpeded run to the finish line.

In doing so, Mr Herbertson elected to remain along the marker peg line following the leader Isitwrongtobeexcited NZ on a track which does not have a sprint lane and as a consequence of the failure to take these options, when Stewards consider it was both reasonable and permissible to do so, it resulted in Treacherous Rock being held up for clear running, and Treacherous Rock not being fully tested and denied full opportunity to win or obtain its best possible placing in the field when finishing 2nd place beaten approximately 3m.  

In assessing penalty Stewards took into account the relevant considerations as outlined within the HRV Stewards Minimum Penalty Guidelines ,usual penalties imposed under this rule, the effect any period of suspension would have on Mr Herbertson, Stewards were also mindful of the relevant deterrent factors that should be associated with any penalty imposed under AHR Rule 149(1) due to the seriousness of the offence, Stewards assessed that the degree of culpability on Mr Herbertson’s part was deemed to be medium range, due to his experience and the points of the race in which the breach of the rule occurred balanced against that stewards were mindful Mr Herbertson had never previously offended under this rule, he had been driving for six (6) years and had more than three thousand three hundred (3300) race drives in this period and accordingly imposed a suspension of his licence to drive in races for a period of four (4) weeks.
