On 19 September 2018, the Victorian Supreme Court considered an application from currently disqualified person Nick Tardio to stay the 23 July 2018 decision of Victorian Civil and Administrative Tribunal (VCAT) Senior Member Gerard Butcher, pending his appeal to the Victorian Supreme Court.
The VCAT decision dismissed an application for review lodged by Mr Tardio in respect of an 18-month disqualification handed down by the Harness Racing Victoria (HRV) Racing Appeals and Disciplinary (RAD) Board on 21 February 2018. The background to the matter can be read here.
At the Victorian Supreme Court, after considering submissions from legal representatives for Mr Tardio and HRV, Judicial Registrar Clayton dismissed the stay application and scheduled the hearing of the appeal to 16 November 2018.
